If a temporary resident of Canada applies to extend his or her status before it expires, then the temporary resident can benefit from implied status.
This means that the temporary resident can continue to remain in Canada under the same terms and conditions as his or her current status document while the extension is in progress.
For example, if a temporary foreign worker applies to extend his or her status before it expires, he or she can continue work and stay in Canada while her extension application is in process.
It is important for clients to understand the following:
1. A temporary resident is not on implied status just because they paid someone to help them file an application and gave that person all of their documents and signed the forms. The application must actually be received by Immigration before the temporary resident’s status expires;
2. Implied status does not allow a temporary resident to do something other than is listed on their current status document. For example, a person on a visitor visa might think that they can start working just because they sent in (or paid someone to send in) a work permit application. This assumption is incorrect;
3. If a temporary resident leaves Canada while on implied status then the temporary resident will lose implied status.
